This is a story out of Philadelphia, but it should be getting national media coverage. I assume it's not because all parties are black, or there are no celebrities involved.

Andrea Kelly,39, is being charged with murder in the death of 14-year-old Danieal Kelly. It was in her Parkside house that Danieal's emaciated body was found. Danieal, who suffered from cerebral palsy, was reportedly kept in a dark room because her mother was embarrassed to take her outside. Danieal died two years ago of starvation while lying in her own feces, with flies buzzing around her mouth and maggot-infested bedsores ravaging her skeletal back.

These four have also been criminally charged in connection with Danieal's death: the now-fired DHS caseworkers Dana Poindexter and Laura Sommerer, and two people who worked at MultiEthnic - one of its founders, Mickal Kamuvaka, and Julius Murray. MultiEthnic was an outside agency that DHS assigned to handle Danieal's case.

Poindexter had allegedly failed to investigate at least five abuse or neglect complaints regarding Danieal and had kept a file on her family at the bottom of a box filled with food wrappers and unopened mail.

Now for the even more despicable part.

The media has done such a marvelous job of throwing the blame solely at the feet of DHS and MultiEthnic, that it has pulled the scum from the bottoms of the ocean - ambulance chasing lawyers.

The parents of the 14-year-old, Danieal Kelly, who face criminal charges in connection with her death, have now also filed a lawsuit against their criminal co-defendants, blaming them for the girl's demise.

The scumbag civil attorneys, Brian Mildenberg and Eric Zajac, who filed the civil suit, contended yesterday that it would be wrong to paint Daniel and Andrea Kelly as money-grubbers.

"The parents are not seeking any money from this," Mildenberg said. "The potential beneficiaries are the brothers and sisters and the parents, but the parents may be disqualified by a conviction or a civil finding of abandonment."

If a jury decides that the estate should get money, Orphans Court would decide who the beneficiaries would be, the attorneys said. They said that Daniel and Andrea Kelly had to be named as administrators of the estate because they are Danieal's parents. They also said that the parents were aware before they were criminally charged that they may not benefit from a civil suit, and they contend that the parents' main concern in the suit is the welfare of Danieal's siblings.

"The beneficiaries could be these kids [Danieal's siblings], and that could be a positive outcome," Mildenberg said.

The attorneys confirmed that they filed the complaint on Aug. 1 because of an approaching two-year federal statute-of-limitations deadline. Danieal died on Aug. 4, 2006, so the suit, which contains federal civil-rights claims, had to be filed within two years of that date.

The wrongful-death suit seeks more than $50,000 and names as defendants the city, DHS, MultiEthnic Behavioral Health, DPW, and the Commonwealth.

To add insult to injury, the 19-year-old brother, Troy Washington, the oldest of Danieal's 10 siblings(from 5 different men) has filed a lawsuit as well. It contends that Washington "has suffered substantial mental pain" from his sister's death.

Zajac said yesterday that Washington, who was 17 when his sister died, tried to kill himself afterward and was admitted to a psychiatric hospital.

"He viewed her dead body before she was removed by the Medical Examiner's Office," he said.

Does anybody else but me wonder, where the hell was he at when this poor girl was rotting away. Could he not have done something, WHEN SHE WAS ALIVE?

Is this what this world has become? Is it now allowable for a mother and father to profit from the death of a child? A death that they caused, no less.

I, for one, do not totally agree that it's DHS' fault. I place the blame squarely on the shoulders of the "mother" and sperm donor.

If we, as a society, are so hell bent on making a government agency responsible for the welfare of all children, should we not come up with some way to keep a mother, such as this animal, from having so many kids? Would that not be the humane thing to do? Can we not force them on birth control until they can prove to be fit parents? This animal had 10 kids. That's 10 kids, well 9 now, that will be fighting against extreme odds to become normal adults. The one thing on this earth that should be free, and mandatory, is birth control.

Can you elaborate on holding the mother accountable? What do you think should be done?

The obvious answer is jail time - LOTS OF IT! She should also be forced to get her "tubes tied" so she cannot bring another child into the world.

I know it will never happen, thanks to that ridiculous organization, the ACLU, but we should force more unfit parents to be on birth control so they cannot continue to bring children into this world. It's a vicious cycle that rarely gets broken. A child is brought into this world under dire circumstances and they repeat the same behavior when they are older.

No, once again, Df, you go off on your own little thing. Birth control! It keeps them from getting pregnant. I don't believe in abortion.

Craftyguy, you of course went even further off course. This has nothing to do with liberal or conservative. This is a justice is far from blind...it's idiotic.

What if the problem that created the 'problem' was held accountable as well??

Maybe if the welfare system did NOT reward an unwed mother (or even wed, for that matter) for popin out babies with more cash and benefits we wouldnt have women doing stupid stuff like this!

As it is; just spread 'em, claim to not know who the father is, and you're rewarded with cash and benefits for being irresponsible; all at the taxpayers expense...
Again, the system creates another way to submit children to something similar to the 'Foster-Care' system, where the children are regarded more as a 'pay-check' than the bearers of our futures...

I see so many responses saying that there ought to be someone held accountable... By all means, but NOT a government agency. How about the person that bore the responseability. Don't know who the father is? NO BENEFITS.

Jay --you are right. She should have been tied and snipped a decade ago. She has no one to blame but herself, and exactly the sperm donor (well spoke), you mentioned.

It is absolutely despicable how our judical systems allow these ridiculous lawsuits to come to fruition. They are all attorney's greasing the palms of other attorney's. That woman should be jailed and made to suffer as her child suffered. Only then would there be true vindication for that life lost. A silent voice heard amongst the outcries of greed and profiteering. Women like her should never have had children to begin with. That child chose not to be born with disabilities. And was subsequently treated like an outcast because of it. How shameful have attorney's moneymongering become to stoop to such lows of human disgust. All the while, strolling through the courtrooms in their polished wingtips and thousand dollar suits stained by the ashes of Hell where they sold their souls.

This is just another case of Far-Leftist Racism on the Left by Nagram. Calling black men sperm donors is.......despicable. And then, attacking the attorneys defending these poor people who are just trying to support their families and have a better life for themselves....absolutely......despicable...

Df--it's obscene you can't see the forest for the trees in front of your face. It has nothing to do with the race card. How overplayed is that!!! Your comments are so far off it is laughable! I seriously believe you are joking! Left-right, forward-backward. This is a case of clear child neglect. Think if your mother did that to you? Or perhaps some slimball attorney defending the nutbag that harmed a member of your family. Poor people? Are you kidding? She was obviously willing to bed down with every Tom,Dick, and Harry that walked by; impregnant herself and thus, keep herself locked in a dead end financial situation. Poor people HA! If you can't take care of'em, don't breed'em.

"Oh the humanity!!! Please somebody throw me a race card so I can lay blame on everyone else, but myself".

"I can't control my own stupidity, nor can I be held accountable for it!!"

I moved here from Nashville about a year and a half ago. I am an aspiring writer. I currently write articles for SoCal Sports Hub, about the LA Dodgers. I also am working on a side project - an essay novel with stories that could only have happened to me. I am fascinated by how I can take a story or a blog and post it and see the many different opinions. I do come across as nasty sometimes to other people, but let me assure you I respect just about everybody's opinions.
