So  Mr. Horn get a way with murder. Alot of different people feel conflicted about how this turned out.. I feel like he should be punish, not because he was defending his neighbor, but because he did not act in self-defense. Even cops are not allowed to shoot if a suspect is not armed and is fleeing.. This is the transcript of what happened.. my comments are in bold red. I dont feel like the suspects should have gotten away with stealing, but to kill them that was not right. Material things come a dime a dozen, insurance all that.. I mean we all feel violated when we get something stolen from us but we have to realize that when we die.. naturally of course, we cant take none of that with us.. but if we sit up and kill someone over materialistic stuff we gonna have to live with the fact we took a life.. who wants to spend their life with that on the conscience??

Horn: "OK, he's coming out the window right now, I gotta go, buddy. I'm sorry, but he's coming out the window. "  

Dispatcher: "No, don't, don't go out the door, Mister Horn. Mister Horn..."

Horn: "They just stole something, I'm going out to look for 'em, I'm sorry, I ain't letting them get away with this --. They stole something, they got a bag of stuff. I'm doing it!"

Dispatcher: "Mister, do not go outside the house."

Horn: "I'm sorry, this ain't right, buddy."

Dispatcher: "You gonna get yourself shot if you go outside that house with a gun, I don't care what you think."

Horn: "You wanna make a bet?"

Dispatcher: "Stay in the house."

Horn: "There, one of them's getting away!

Dispatcher: "That's alright, property's not something worth killing someone over. OK? Don't go out the house, don't be shooting nobody. I know you're pissed and you're frustrated but don't do it."   (So he is warned not to go outside.. point blank)

Horn: "They got a bag of loot."

Dispatcher: "OK. How big is the bag?" He then talks off, relaying the information.

Dispatcher: "Which way are they going?"

Horn: "I can't ... I'm going outside. I'll find out."

Dispatcher: "I don't want you going outside, Mister..."

Horn: "Well, here it goes buddy, you hear the shotgun clicking and I'm going."

Dispatcher: "Don't go outside."

On the tape of the 911 call, the shotgun can be heard being cocked and Horn can be heard going outside and confronting someone.

"Boom! You're dead!" he shouts. A loud bang is heard, then a shotgun being cocked and fired again, and then again.  (Chilling, I cant believe he did that)

Then Horn is back on the phone:

"Get the law over here quick. I've now, get, one of them's in the front yard over there, he's down, he almost run down the street. I had no choice. They came in the front yard with me, man, I had no choice! ... Get somebody over here quick, man."

(He had no choice? he certainly did he could have stayed in the house.. plus the men was running not trying to attack him this is not right!! )

Dispatcher: "Mister Horn, are you out there right now?"

Horn: "No, I am inside the house, I went back in the house. Man, they come right in my yard, I didn't know what the -- they was gonna do, I shot 'em, OK?"

(Thats a lie those men were trying to run away who runs up against someone with a shotgun. He shot them because he was mad that they was robbing his neighbor and was almost at risk of getting away)

Dispatcher: "Did you shoot somebody?

Horn: "Yes, I did, the cops are here right now."  ( So there we have it the cops showed up immediately after he shot the guy. If he had of let it be they would have been caught)

Dispatcher: "Where are you right now?"

Horn: "I'm inside the house. ..."

Dispatcher: "Mister Horn, put that gun down before you shoot an officer of mine. I've got several officers out there without uniforms on."

Horn: "I am in the front yard right now. I am ..."

Dispatcher: "Put that gun down! There's officers out there without uniforms on. Do not shoot anybody else, do you understand me? I've got police out there..."

Horn: "I understand, I understand. I am out in the front yard waving my hand right now."

Dispatcher: "You don't have a gun with you, do you?

Horn: "No, no, no."

Dispatcher: "You see a uniformed officer? Now lay down on the ground and don't do nothing else."

Yelling is heard.

Dispatcher: "Lay down on the ground, Mister Horn. Do what the officers tell you to do right now."

Basically he deserved to be punished. When society begins to think they can take justice in their own hands.. then why will we need police, judges, and a jury? We can just be our own public servants!!!

I would expect this reaction from someone who had issues with the law.
Texas Penal Code allows for deadly force to be used in order to prevent a felony, especially if the property being stolen would be unrecoverable. Horn was totally within his rights.
Those illegal alien losers put their lives on the line for a pillowcase of jewelry and money to which they had not one right, they charged Horn, one of them with a crowbar, and they got shot. They gambled and lost.
It is the duty of EVERY CITIZEN to uphold the laws of the land. To sit back and cower in the corner while a crime is committed makes one just as guilty as the criminal, IMHO.
I own two guns. I know how to use them, and I will if someone jacks with my family, me, or my property.
Think a 'human' life is worth more than property? Then don't jack with other peoples property. They may NOT agree.

I understand where you are coming from in respect to the fact that we can't just take the law into our own hands. But consider this...if Horn had not acted...the chances of these men escaping to commit further crimes was extremely high.

Now...consider this: If these same men did escape and happened to rob your place next, would you wish no harm to come to them?

wow.. so you assume he was charged with a crow bar.. how so when they said the dudes were shot in the back.. get it right.. read and study your facts.. and understand that i dont have an issue for the law.. i speak my mind.. and he was wrong..

he called the cops that was what he should have done.. and left it at that. but no he wanted to be a hero and he went outside and shot the men because he thought they were gettign away.. like i said the cops pulled up right after they were shot.. undercovers did.

another thing i want to point out is i have had my things stolen before it happens.. i get mad but i would never kill someone unless they were attempting to hurt me.. not steal from me.. you see he shot those men and he regrets it.. why because he killed someone over materialistic stuff..

cd, I do not 'assume' anything. I live in Pasadena, the house that was burglarized was owned by the people who also own and operate my drycleaners and I annoy both they AND Pasadena police officers I run into at my apartment (Sandridge apartments), at the store, (from Coney Island, Kroger, to the corner store where I buy my morning cappucino) with endless questions. The undercover officer ON THE SCENE, the officer who TESTIFIED in front of the GRAND JURY, the officer who was also BLACK, in case you didn't know that, said that Ortiz approached Horn with a crowbar. They found a crowbar on Horn's property. They found fingerprints that matched the criminals ON the crowbar.
My only issue with this incident was NOT the scumbag criminals getting shot, but why didn't the undercover cop activate his bubble light? Maybe it would have prevented this tragedy.

I have ALSO been the victim of theft. T-tops in 1988, auto theft in both 1994, and 1996..and between 93-94 my car was broken into and my gymbag stolen..they were looking for my little 22 handgun, I think, (we found the gym bag and its contents in the dumpster) but they didn't get it. I would have NOT ONE IOTA of COMPUNCTION about shooting someone trying to steal from me, not one bit.
