Does the punishment fit the crime? 

A jury has sentenced Elizabeth Shelton to eight years probation for driving drunk and causing the death of her boyfriend, Matthew McNiece.  As part of her probation, she'll have to spend 120 days in jail and pay a $10,000 fine.  Mothers Against Drunk Driving says this is standard punishment and doesn't believe Shelton got preferential treatment because her dad is Harris County Judge Pat Shelton. 

To recap the case:  Last year, 19 year-old Shelton had a blood alcohol concentration of more than three times the legal limit when she got behind the wheel.  In an instant the lives of two families were changed forever.  Shelton slammed into the back of a large truck on the freeway.  The impact killed and almost decapitated McNiece.  The defense maintains the truck driver veered into Shelton's lane and intoxication played no role.

As part of her probation, I would have required her to make public speaking appearances about the dangers of drunk driving, Sally Mac.

I think it sounds like her boyfriend's decision to get in the car with someone that was intoxicated is being completely overlooked. We're too educated now, we know the effects alcohol has on a person's ability to drive. He knowingly got in the car with her, he knowingly risked his life. Or maybe he didn't, I don't know...

That doesn't make anyone feel better. No there isn't much justice in it. What was the question in the case? Did the actions of the truck driver play absolutely no part seeing as how she had already broken the law, and then afterward she's guilty for every subsequent consequence of breaking that law; or were underage drinking, drinking and driving, and vehicular manslaughter all treated as separate infractions? You don't get to use alcohol as a defense in court, but it also isn't an automatic assumption of guilt. If her boyfriend, if he were intoxicated, was driving would the results have been any different? Who is more responsible for his death; her for driving intoxicated, or him for getting in the car with someone that was intoxicated? Its completely different when the driver of the other vehicle is killed, because they didn't have a choice.

Is it going to ease the pain of either family by this girl suffering in addition to the suffering thats already occurred? I doubt it. Is it going to deter others from making impaired decisions in the future? Unfortunately, probably not. So then is it keeping with letter of the law making sure that without reasonable doubt the person responsible for his ill fate is being handed justice? Well, si

I think she got a slap on the hand because if i was to get charged with the sam thing i would get no less than 10-20 years if not life so i do not think she hade a fair trial just because her dad is a judge she got a slap on the hand.

Well, since we don't know if him driving would have changed the circumstances at all, well, we just don't know that without a shadow of a doubt she is responsible for his death. You don't speak ill of the dead, so you don't blame him. Now you have a living person who you can either minimize the suffering of all involved, or further penalize her by adding to the guilt that will never go away, a scarlet letter "F" for Felon.

I believe the punishment do not fit the crime. She took another person's life and is allow to walk free with some minor punishments. This only shows how weak are laws are to support the ideal the driving under the influence is wrong. Thats probably why many people do it, cause it would seem that the laws that are impose is not that bad.

I think it is ridiculous how her father actually think politics did not play a part in her punishment. My brother was sentenced to twenty years in prison for the same crime and his intoxication level was not nearly as close as hers. She should have been sentenced to serve a minimum of five years in prison, especially since she was underage and should have not been drinking to begin with. It does not matter if it was her boyfriend’s decision to get in the vehicle with her, he is now dead and she should be held fully responsible. What is the point of making laws when anybody with power can make them their own?

I cannot believe that all she received was a slap on the hand for contributing to the death of a human and they want to imprison Mike Vick for contributing to the death of animals.

I must have missed something here. The facts are she was driving the vehicle. She had an accident that killed someone. Sorry but she is responsible for the death plain and simple. There are no other options. She was driving and she is responsible !

You know if this had been a black or latino, they would be thrown under the jail for the maximum 20 years. She also has the benefit of her father being a judge. Those are the reasons she got the slap on the wrist for murder.

I was born and raised here in Houston and have never been in any other place in this country that has more corrupt politicians than here. The good ol' boy network is alive and well and functioning as the corrupt politicians expect it to !!!! It's time for people to see these things for what they really are, and to vote people in office that will really make a change and put this racist archaic mindset to rest once and for all !!!!!!!

Are you saying that this young woman should not be punished for her actions? She is 20 years old ( which everyone knows is not the legal age for drinking) and her blood-alcohol level more than three times the legal limit for driving in the state of Texas. You said that her boyfriend got in the car willingly knowing she was drunk which honestly was not the best of decisions... but youre saying for that decision, he deserved to die???? She knew how drunk she was and any intelligent person knows when its time to stop. Also if she was drunk she should have gotten someone else to drive or pick them up. She should not have gotten in the drivers seat PERIOD. When you make dumb decisions you dont put other peoples life in danger along with your own. Her actions were completely unintelligent and selfish. Yes, I do think that her father being a judge is the reason she is getting off so easily. YES I think she should pay for what shes done....INTOXICATED MANSLAUGHTER. Those are the 2 words that describe this case end of story
